Fact : Stoker and Chris White didnt get ANY rights for the songs they used.
Heres some info..."Music that has been recorded and issued on CD is protected by 2 copyrights. To use a recording of a musical composition in your work, you need to get permission from both copyright holders.
The
first permission you need is from the music’s publisher.
The second permission is for the recording itself. To get this, you would approach the record company that released the recording. The record company holds the copyright for the actual performance of the song captured and mastered on tape and released on CD.
Q: What licenses do I need?
A: You need a
Synchronization License to use music in your media project. This license is issued from the music publisher. The Synchronization License
gives you the right to “synchronize†the copyrighted music with your images and dialogue. In our case, video footage of bodyboarding.
Here's the tricky bit...having a sync license means you have permission from the publisher to use the music but it doesn’t give you the right to use a specific recording of the composition. For that you need a
Master Use License. This license is issued directly from the record company. Fees can range from a few thousand dollars to millions of dollars depending on the popularity of the music.
Then say for example you want to you want to edit the song, maybe cut off the beginning 30 secs and maybe have a few parts during the song where you fade out the song completely in order to incorporate some backround talking, eg. someone hooting their mate into a fat barrel.
You then need written permission to alter the composition!!!
Humour me for a second....
Chris White : "Hi is that the Sony big-wig?"
Sony 'Big-Wig' : "Yes it's me"
CW : "Hi, my names Chris, im currently producing a bodyboarding
video, I'm using a song by Queen/Toto/Jurassic5, and I
would just like to know whether its possible to cut out the
middle piece of the composition in order to incorporate the
throwing of shit/puking/swearing, which I believe will enhance
the nature of the video?"
SBW: "Um...sure buddy,why not!"
Somehow i doubt it...
As regards whether the music should be local or international, I say whatever the editor personally thinks sounds the best and gets everyone the most amped, that should be used.
We should'nt discriminate against bands just because they're American...shame
